Agreement to Terms

ABAOps, LLC ("ABAOps") provides the Google Ads management service described below (the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

ABAOps provides Google Ads management for ABA providers: account review, conversion-measurement verification, campaign build or repair, and monthly outcome reporting, performed under a written service agreement. The Service also includes market and keyword analysis tools used to prepare that work.

Use of Service

Permitted Use

You may use the Service to:

• Research keyword data for legitimate ABA therapy practice marketing
• Analyze market opportunities in specific geographic areas
• Export data for your business planning and marketing purposes
• Use insights to inform your Google Ads or SEO strategies

Prohibited Use

You may NOT:

• Resell or redistribute the data provided by the Service
• Use automated tools (bots, scrapers) to access the Service
• Attempt to reverse engineer or copy the Service
• Use the Service for any illegal or unauthorized purpose
• Abuse the Service in a way that impacts other users
• Misrepresent data or results provided by the Service

Data and Accuracy

Data Sources

Our Service uses data from:

• Google Ads Keyword Planner (keyword search volumes, CPC median bid estimates) collected via DataForSEO as monthly snapshots across 100 US metros
• Our proprietary taxonomy and algorithms (keyword classification, intent scoring, campaign segmentation)
• Geographic databases (ZIP code resolution, DMA boundaries)

No Guarantees

While we strive for accuracy, we provide the Service "as is" without warranties:

• Data accuracy: Keyword data is sourced from Google Ads Keyword Planner via DataForSEO and reflects median bid estimates, not live auction prices. Actual CPC may vary.
• Results: We do not guarantee specific marketing results or ROI from the services
• Availability: Service uptime and data availability may vary
• Estimates: Conversion rates and ROI projections are estimates only

Important: You are responsible for validating data and making your own business decisions. Do not rely solely on our estimates for significant business commitments.

Accounts and Billing

Account Creation

Some features may require account creation. You agree to:

• Provide accurate and current information
• Maintain the security of your password
• Notify us immediately of unauthorized access
• Accept responsibility for all activities under your account

Billing

If you are a paying client:

• Fees: Fees for the Service are set out in a written service agreement, provided before account access begins
• Cancellation: Cancellation terms are set out in the service agreement and provided before account access is granted
• Refunds: Handled per the terms of the service agreement
• Fee changes: We'll provide advance notice before any change to fees for an active engagement
• Signed agreement controls: Where a signed services agreement exists between ABAOps and a practice, that agreement governs the services and controls over these Terms.

Service Plans

Services are provided under a written service agreement. Fees are quoted after the account and launch path are reviewed. Google advertising costs are billed by Google directly to the client, separate from our service fee.

Intellectual Property

Our Rights

The Service, including all content, features, and functionality, is owned by ABAOps, LLC and protected by copyright, trademark, and other intellectual property laws.

Your Rights

You retain all rights to your account data and content. When you export data, you may use it for your business purposes.

License

We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. This license terminates if you violate these Terms.

Data Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand our data practices.

• Encrypted in transit (TLS)
• Encrypted at rest by our database and storage providers
• Role-based access controls
• You may stop using the Service at any time. To delete your account and the data associated with it, email support@abaops.ai and we will confirm when it is done.

Limitation of Liability

No Consequential Damages

To the maximum extent permitted by law, we are not liable for:

• Lost profits or revenue from using (or inability to use) the Service
• Decisions made based on data provided by the Service
• Indirect, incidental, or consequential damages

Maximum Liability

Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim (or $100 if you haven't paid anything).

Exceptions

Some jurisdictions don't allow limitation of liability for personal injury or certain types of damages. These limitations may not apply to you.

This tool provides data and insights, NOT professional advice.

• We are NOT providing medical, legal, financial, or business consulting advice
• Keyword data should inform, not replace, professional judgment
• Consult with qualified professionals (marketing consultants, attorneys, accountants) for specific advice
• Marketing results depend on many factors beyond keyword selection

Termination

By You

You may stop using the Service at any time. To delete your account and the data associated with it, email support@abaops.ai and we will confirm when it is done.

By Us

We may suspend or terminate your access if:

• You violate these Terms
• You abuse the Service or impact other users
• Required by law
• We discontinue the Service

We'll provide reasonable notice unless immediate termination is necessary for security or legal reasons.

Changes to Terms

We may modify these Terms from time to time. We will:

• Post updated Terms on this page
• Update the "Last Updated" date
• Notify active users via email (for material changes)
• Provide 30 days notice for material changes affecting paid services

Continued use after changes means you accept the new Terms.

Dispute Resolution

Informal Resolution

If you have a concern, please contact us first. We'll try to resolve it informally.

Jurisdiction

These Terms are governed by the laws of California, United States. Any disputes will be resolved in the courts of California.

Arbitration (Optional)

For disputes under $10,000, we may both agree to binding arbitration instead of court.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ABAOps, LLC.

Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

No Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right.

Assignment

You may not transfer your rights under these Terms. We may assign our rights to a successor or affiliate.
